Terms & Conditions — Shop (Marketplace)
The Crowdfactory marketplace is operated by CROWD FACTORY LTD, 71 to 75, Shelton Street, Covent Garden, London, WC2H 9JQ, UNITED KINGDOM (Registered in UNITED KINGDOM, Number 16843422) — hello@crowdfactory.shop. These Terms govern all purchases made on the Shop.
1. Definitions
- Customer: a buyer on the marketplace.
- Designer: the creator who lists and sells a product design on the Shop.
- Maker: an independent producer who manufactures and ships products on behalf of Designers via the Platform.
- Crowdfactory / Platform: CROWD FACTORY LTD acting as intermediary.
- Order: a purchase placed by the Customer.
2. Scope & contract formation
By placing an Order, the Customer accepts these Terms. The contract is formed when the Order is confirmed.
The Platform intermediates the transaction; the Designer lists and sells the item; the Maker manufactures and delivers it as a service provider to the Customer.
3. Prices, taxes, and payment
Prices are displayed inclusive of applicable taxes. Payments are processed exclusively via Stripe.
Upon payment, the net amount (after applicable taxes and Stripe fees) is split between Designer (for the design), Maker (for fabrication/fulfillment), and Platform.
The Platform may place funds in escrow or hold reserves to manage refunds/chargebacks.
4. Availability & production
Many products are made-to-order or printed on demand. Production times are estimates only.
If a product cannot be produced within a reasonable time, the Customer will be offered a refund.
5. Delivery & risk of loss
The Maker is responsible for packaging and shipping. Risk of loss passes to the Customer upon delivery according to the selected shipping terms.
The Customer must provide accurate delivery information; extra costs from incorrect addresses may be charged to the Customer.
6. Right of withdrawal, refunds & returns
- Customers in the EU have a 14-day withdrawal right from delivery without giving any reason.
- To exercise, contact hello@crowdfactory.shop with your order info.
- Refunds are processed by the Platform; physical returns are handled by the Maker.
- Return shipping costs are borne by the Customer unless the item is defective or non-conforming.
- Note: clearly custom-made/personalized items may be exempt from the statutory withdrawal right under EU law; this is stated on the product page and/or at checkout where applicable.
7. Non-conformity & warranty
Makers are responsible for the conformity and quality of the manufactured product they produce for the Customer.
Designers are responsible for the legality and fitness of the designs they list and sell.
In case of defects or non-conformity, the Platform will mediate between Customer, Maker, and Designer to organize repair, replacement, or refund in accordance with applicable law.
8. Prohibited items
Designers may not list or sell illegal items, weapons, counterfeit goods, adult content, or items that infringe third-party IP rights.
The Platform may remove such listings and take appropriate action.
9. Design license & manufacturing mandate
- Designers retain ownership of their designs but grant Crowd Factory a non-exclusive licence to list, promote, sell, and mandate Makers to manufacture the ordered products for Customers.
- This licence enables the Platform to share necessary design files with Makers solely to fulfil the Order.
- Designers warrant they have all rights needed to grant this licence; Makers are paid for production services and must follow the provided instructions and standards.
10. Data sharing & privacy
The Platform shares Customer data with Makers strictly for fulfillment. See the Shop Privacy Policy for details.
11. File protection & IP safeguards
- Crowd Factory applies protective measures to restrict downloading or extraction of protected design files by users and manufacturing partners.
- If the system detects an attempt to download, copy or unlawfully access a protected file, the file may be disabled and access blocked.
- While we apply reasonable protections, we cannot guarantee absolute prevention of piracy or unauthorised use. Crowd Factory is not liable for losses resulting from third-party misuse of files.
12. Liability
The Platform acts as intermediary and is not the manufacturer.
Subject to mandatory law, the Platform is not liable for indirect or consequential damages. Nothing excludes liability that cannot be excluded by law.
13. Disputes
These Terms are governed by British law. Disputes are subject to the competent British courts, without prejudice to mandatory consumer protections and jurisdiction rules.
